Credit Card Fraud

Many credit card crimes are also charged as theft or identity theft. Under Maryland’s identity theft statute, a credit card number qualifies as personal identifying information, and the identity theft statute is often read by court commissioners to cover the behavior of people who merely use another person’s credit card, even if they do not explicitly claim to be the person who is named on the credit card.

Crimes relating to credit card fraud are often complicated, partly because of the higher complexity of the underlying allegations, and partly because the laws involved tend to have many elements that defy easy description. However, that complexity can sometimes work in your favor, as the state may charge you improperly or charge you with the wrong offense, and each and every element of the crime charged must be proven before you can be found guilty.

Maximum Penalties for Credit Card Fraud Crimes

  • CR 8-203 – Fraud in procuring issuance of a credit card: misdemeanor, 18 months and $500
  • CR 8-204 – Credit card theft: misdemeanor, 18 months and $500
  • CR 8-205 – Credit card counterfeiting: felony, 15 years and $5,000
  • CR 8-206 – Obtaining property with a stolen or counterfeit credit card with a value less than or equal to $100: misdemeanor, 90 days and $500
  • CR 8-206 – Obtaining property with a stolen or counterfeit credit card with a value less than or equal to $500: misdemeanor, 18 months and $500
  • CR 8-206 – Obtaining property with a stolen or counterfeit credit card with a value over $500: felony, 15 years and $1,000
  • CR 8-207 – Honoring a stolen or counterfeit credit card with a value less than or equal to $100: misdemeanor, 90 days and $500
  • CR 8-207 – Honoring a stolen or counterfeit credit card with a value less than or equal to $500: misdemeanor, 18 months and $500
  • CR 8-207 – Honoring a stolen or counterfeit credit card with a value over $500: felony, 15 years and $1,000
  • CR 8-208 – Completing a credit card without consent: felony, 15 years and $1,000
  • CR 8-209 – Receiving property obtained with a counterfeit credit card with a value less than or equal to $100: misdemeanor, 90 days and $500
  • CR 8-209 – Receiving property obtained with a counterfeit credit card with a value less than or equal to $500: misdemeanor, 18 months and $500
  • CR 8-209 – Receiving property obtained with a counterfeit credit card with a value over $500: felony, 15 years and $1,000
  • CR 8-210 – Publishing a number or code of a telephone credit card: misdemeanor, 12 months and $500
  • CR 8-214 – Unauthorized Use or Disclosure of a Credit Card Number: felony, 15 years and $1,000, with an additional civil penalty of $1000
  • CR 8-301 – Fraudulently possessing or obtaining personal identification information used to obtain goods with a value less than or equal to $500: misdemeanor, 18 months and $5,000
  • CR 8-301 – Fraudulently possessing or obtaining personal identification information used to obtain goods with a value over $500: felony, 15 years and $25,000
